§ 14-5. Damages to streets, sidewalks, curbs and gutters—Bond requirements

  • (a) All owners of property, their agents and their contractors who shall obtain a building permit for construction or repairs to existing land and structures located in the Town of Kure Beach whether said structures be residential or commercial shall be required to post a cash bond, the amount to be determined by the building inspector after determining the area to be used by any type of vehicle of whatever kind or nature which shall travel upon, across, over and through the existing streets, sidewalks, curbs and gutters located at or near the permitted site.

    (b) Should the above construction or repairs involve the use of someone else's land or property other than the permittee's land for purposes of ingress and egress; than and in that event, written permission shall be required from the owner regarding the use of the land for ingress and egress prior to the issuance of any permit.

    (c) The bond required shall be deposited with the town treasurer which shall consist of a certified check or cash for such sum as the building inspector may think sufficient, but not less than five hundred dollars ($500.00) nor more than two thousand five hundred dollars ($2,500.00) before the commencement of such work. Such check or cash shall be held by the town treasurer as a pledge that the owners of property, their agents and their contractors or other persons will at once repair or cause to be repaired any damage to the street, sidewalk, curb and gutter and if not done, the town shall deduct the cost of repairs from the amount of such check or cash deposit. The residue, if any, shall be paid to the person entitled to receive the same. Where the amount deposited is insufficient, the difference due shall be paid by such property owner, their agents or their contractors or other person and any default thereof may be collected by suit. All persons making the deposit hereunder, having complied with these requirements shall be released by the building inspector upon the issuance of a certificate of occupancy or compliance.
